Rental Agreement for Holiday Accommodations & General Terms and Conditions (GTC)

For the Property: All in Rhein-Main, Premium Retreat Apartment in Ginsheim-Gustavsburg

§ 1 Contracting Parties, Scope of Application & House Rules

(1) This contract governs the temporary provision of the holiday apartment for residential use between the owner/host (hereinafter referred to as the "Lessor") and the booking guest (hereinafter referred to as the "Lessee").

(2) Validity without Signature: This rental agreement becomes legally binding without a physical or handwritten signature. It enters into legal force as soon as the Lessee completes the booking process (via an online platform or through direct confirmation) and the Lessor confirms the booking.

(3) House Rules as an Integral Part of the Contract: By completing the booking, the Lessee explicitly and fully accepts this rental agreement as well as the House Rules of the property in their currently valid version as a binding component of the contract. The House Rules are displayed in the rental property and govern detailed regulations regarding usage and conduct (particularly for the spa, pool, hot tub, sauna, and gym areas). In the event of contradictions or additions, the provisions of the House Rules apply continuously and supplementally to this agreement.

§ 2 Rental Property & Scope of Use

(1) The Lessee is granted exclusive use of the separate apartment, the corresponding terrace area, and the parking space for the booked period solely for holiday/recreational purposes.

(2) The apartment has a separate entrance via the terrace, accessible via the ABUS App. The Lessee undertakes to install the application prior to arrival.

(3) Subletting or transferring the property to individuals who are not registered or listed in the booking is strictly prohibited.

§ 3 Arrival and Departure (Check-in / Check-out)

(1) The rental property is available from 3:00 PM onwards on the day of arrival (or by individual arrangement).

(2) On the day of departure, the apartment must be vacated by 10:00 AM. The Lessee undertakes to strictly adhere to the following check-out requirements prior to departure:

• Damages: Any damages or defects caused during the stay must be reported to the Lessor immediately and prior to departure.
• Linens & Waste: Used towels and bathrobes must be collected and placed inside the shower. Waste must be separated and disposed of in the designated waste bins located at the terrace entrance.
• Kitchen & Grill: The kitchen and all utilized electrical appliances must be left thoroughly cleaned. If the provided gas grill was used, it must also be returned in a clean condition. Failure to comply will result in the following special cleaning fees:
  • Uncleaned electrical appliances (oven, coffee machine, etc.): 50.00 €
  • Uncleaned dishes/kitchen utensils: 25.00 €
  • Uncleaned gas grill: 50.00 €
• Locking up: The apartment must be left swept clean, all lights must be turned off, the refrigerator must be emptied, and the door must be securely locked via the ABUS App upon departure.

§ 4 Spa & Gym Utilization (Complimentary Bonus)

(1) The Lessor provides the Lessee with access to the large outdoor pool, the sauna, and the fitness room (gym) as a voluntary, complimentary bonus.

(2) Operating Hours: The use of these areas is permitted on weekdays (Monday – Thursday) from 4:00 PM to 9:00 PM and on weekends (Friday & Saturday) from 4:00 PM to 10:00 PM.

(3) Hygiene Regulations: Showering thoroughly before using the pool and sauna is mandatory. A strict glass ban applies to the entire spa and pool area. A sufficiently large towel must always be placed underneath the body when using the sauna benches or gym equipment.

(4) Exclusion: In the event of temporary unavailability of the spa facilities due to technical, hygienic, or adverse reasons, there is no entitlement to a reduction in rent (rental mitigation) or financial reimbursement.

§ 5 On-Site Paid Additional Services (Optional Extras)

Billing for all extras used on-site takes place on the day of departure. Payment is made easily via cash (using the envelope provided on the kitchen table) or by alternative arrangement:

• (1) Hot Tub Package (2-hour session):
  • Summer Season (May – September): 50.00 € (includes exclusive use of the large outdoor pool).
  • Winter Season (October – April): 35.00 € (large outdoor pool is closed).

  Condition: Request/registration must be made at least 2 hours in advance. For safety and hygiene reasons, operation/activation may only be carried out exclusively by the Lessor. In the event of excessive or rule-breaking contamination (e.g., caused by oils, food) that requires a full water change, a cleaning flat fee of 150.00 € will be charged.

• (2) Textile Rental: Beach towels, sauna towels, or bathrobes can be rented subject to availability for 10.00 € per person per stay.
• (3) Mini-Market & Drugstore: The goods provided in the kitchen cupboard and bathroom are marked with prices. Taken items, as well as any coffee and tea consumption, must be honestly recorded in the mini-market list.
• (4) Laundry Service: For the use of the washing machine and dryer, a fee of 5.00 € per load (including detergent) will be charged.
• (5) Personal Training: Training sessions with a professional, certified Personal Trainer & Medical Trainer can be booked from 50.00 € per 50 minutes upon prior appointment arrangement.

§ 6 Events, Commercial Use & Photoshoots

(1) The rental property is intended solely for private recreation. Parties, events, coachings, or gatherings of any kind are strictly permitted only in the outdoor area (terrace/garden) and require prior arrangement and explicit approval. The interior of the apartment may not be used for these purposes.

(2) For approved events in the outdoor area, a per-person flat fee of 50.00 € per external guest applies, alongside a cleaning flat fee of at least 150.00 €. Overnight stays for external guests are not included and must be booked and paid for separately.

(3) Venue-Only Rental: For approved events and commercial utilization, the Lessor provides exclusively the location (the space in the outdoor area). All required equipment, event technology, decorations, and the complete furnishings (seating, tables, etc.) must be brought and organized entirely by the Lessee. The inventory and furniture of the apartment may not be moved outside or used for the event.

(4) Professional photoshoots, video recordings, or commercial content productions are likewise only permitted in the outdoor area, require prior registration, and will be charged separately between 500.00 € and 1,500.00 € per day depending on the scope.

(5) Non-registered events, violations of the indoor usage ban, or unauthorized commercial activities will result in immediate eviction from the premises without reimbursement of the rental price.

§ 7 Honesty, Damage & Theft

(1) Missing textiles at the time of departure will be invoiced to the Lessee as follows: Bathrobe 60.00 €, large sauna towel 35.00 €, standard towel 15.00 €.

(2) The unpaid removal of goods from the mini-market, as well as the theft of any inventory, will be treated as theft, invoiced retroactively, and reported to the respective booking platform.

(3) For severe soiling or violations of the spa rules that necessitate unscheduled special cleaning of the apartment or wellness area (e.g., stained sauna wood, vomiting, heavy stains), a flat fee of at least 150.00 € will become due.

§ 8 Disclaimer of Liability & Legal Provisions

(1) The use of the rental property (including the outdoor areas, pool, hot tub, fitness room, sauna, and all other facility sectors) as well as all devices therein is done exclusively at the Lessee's, their family members', accompanying persons', and visitors' own risk, hazard, and liability.

(2) The Lessor assumes no liability for damages, thefts, losses, or accidents incurred by the Lessee or third parties in connection with the usage. The Lessor's liability is strictly limited to intent and gross negligence.

(3) The aforementioned limitation of liability does not apply to damages arising from injury to life, body, or health resulting from a negligent or intentional breach of duty by the Lessor or one of their vicarious agents.

(4) The Lessee hereby indemnifies the Lessor from any and all liability claims asserted against the Lessor by third parties (in particular by visitors or guests of the Lessee) in connection with the use of the rental property, unless the Lessor caused the damage intentionally or through gross negligence.

§ 9 Closing Provisions & Severability Clause

(1) Amendments and supplements to this contract must be made in text form.

(2) Should individual provisions of this agreement be invalid or unenforceable, or become invalid or unenforceable after the conclusion of the contract, the validity of the remaining provisions of the contract shall remain unaffected. The invalid or unenforceable provision shall be replaced by a valid and enforceable regulation whose effects come closest to the economic objective originally pursued.
